司法拍卖是指法院按照法律规定强制对债务人的资产以公开竞价的方式出 让给出价最高的竞拍人,并以所得的价款清偿债务的司法处置手段,是银行快速 处置不良资产、提升风险抵御能力的重要手段。而不动产是司法拍卖中标的金额 最大、数量最多也是最常见的标的物,由于司法拍卖的房产往往比市场上同等价 位的房产要便宜,因此法拍房也越来越受到了大家的关注。 在这样的背景下,许多个人购房者也开始参与竞拍购买法拍房产,银行和担 保公司等金融机构也纷纷加入这一业务领域,提供相应的金融服务。本文通过运 用风险管理的理论和方法,发现深圳市立德融资担保有限公司(以下简称立德担 保公司)法拍房贷款担保业务的三种风险因素来源:内部风险因素、外部风险因 素和不可抗拒风险因素,进而根据法拍房贷款担保业务的特点,利用德尔菲法和 问卷调查法对法拍房贷款担保业务所涉及的风险因素进行逐一识别,再利用层次 分析法为法拍房贷款担保业务的风险因素进行权重赋值,最后针对不同的风险因 素制定差异化的风险控制策略,降低立德担保公司法拍房贷款担保业务的风险。 本文对立德担保公司法拍房贷款担保业务的风险进行识别、分析、评价和控 制程序,建立了法拍房贷款担保业务的风险管理办法,有效解决了法拍房贷款担 保客户的风险管理的问题。将立德担保公司法拍房贷款担保业务的风险管理工作 推向了标准化,降低了法拍房贷款担保业务出风险的机率,提高了立德担保公司 法拍房贷款担保业务的风险管理工作的效率和风险管理水平。 关键词:司法拍卖,法拍房,贷款担保,风险管理 MBA学位论文作者:谢铄 立德担保公司法拍房贷款担保业务的风险管理研究 II RESEARCH ON RISK MANGEMENT OF FORECLOSURE HOUSING LOAN GUARANTEE BUINESS OF LIDE GUARANTEE COMPANY Abstract Judicial auction refers to the judicial disposal method in which the court compels the court to oblige the debtor's assets to be transferred to the bidder with highest price in accordance with the law and to settle the debt with the proceeds. It is an important method for banks to quickly dispose of non-performing assets and improve their ability to resist risks. Immovable property is the largest amount, the largest number and the most common subject in judicial auctions. Since judicial auctions are often cheaper than those on the market at the same price, foreclosures have also received more and more attention. Under this background, many individual home buyers have also begun to participate in the auction of legally purchased real estate, and financial institutions such as banks and guarantee companies joined this business area to provide corresponding financial services. Through the use of theories and methods of risk management, this paper finds three sources of risk factors for Shenzhen Lide Financial Guarantee Co., Ltd. (hereinafter referred to as Lide Guarantee Company) foreclosure loan guarantee business: internal risk factors, external risk factors, and force majeure. According to the characteristics of the foreclosure housing loan guarantee business, the Delphi method and the questionnaire survey method were used to identify the risk factors involved in the foreclosure housing loan guarantee business, and then the analytic hierarchy process is used to assign statistical weights to the risk factors of the foreclosure housing loan guarantee business, and finally, specific risk control strategies are formulated for different risk factors to reduce the risk of the real estate loan guarantee business of Lide Guarantee Company.
