摘要
摘要
随着世界经济全球化程度的加深和不断演变，国家之间的科技竞争日益加剧。高
校作为知识产权的发源地，聚集了一大批优秀人才和科研资源，能够带动周边知识产
权的发展进步。尤其是党的十八大以来，我们国家敏感意识到具有原始创新性的关键
基础技术和中医药卡脖子创新技术的缺乏，加强原始创造技术壁垒和卡脖子技术攻关，
形成具有完全自主知识产权的大批高科技成果显得尤为重要。中医药是我国优秀的文
化传承，也是最具有代表性的自主知识产权成果，中医药知识产权创造也是对我国文
化传承的创新，在此背景下具体分析和研究中医药知识产权创造具有现实意义。
本文以 X高校的中医药知识产权创造为研究对象，具体采用文献研究和实证相
结合的方法，具体内容包括有几下几点：
首先，对国内外现有的中医药知识产权研究进行概述，归纳总结近五年来国内外
文献关于知识产权创造的研究现状，分析研究现状和梳理其基本问题；分析目前学者
们的研究方法和方向，并对本文所采用的方法和内容进行概述。
第二，结合 X高校的中医药创造现状，通过大为搜索引擎对 IPC专利分类搭建
了 X高校中医药专利数据库，分别从横向和纵向对比了专利申请、授权等中医药知
识产权的发展情况。参考《高等学校科技统计资料汇编》建立了知识产权投入和产出
评价指标，选用 SPSS18.0软件通过因子分析法对中医药知识产权创造能力方面的投
入和产出能力进行因子分析，将 X高校因子分析所获取的投入和产出因子运用 SBM
建模与七所不同层次的双一流中医药高校进行超效率分析，进而通过 DEA模型投影
分析方法，找到各个指标对综合效率的影响，发掘中医药知识产权创造的各个影响层
面。
最后，通过分析发现了 X高校知识产权管理水平低、中医药知识产权创造能力
不足、人力投入未合理应用的关键问题。究其原因主要有：高校管理层对知识产权重
视度不够、职能部门管理脱节、X高校政策导向和激励机制不合理、中医药知识产权
政策制度不完善以及缺乏高层次复合型人才等。提出了完善 X高校知识产权管理制
度；强化 X高校的知识产权导向以及提高科技人员积极性、提升中医药科技人员的
知识产权意识的决策建议用于提升其知识产权创造能力；以及加大中医药科研人才的
培养和引进力度的决策建议。

Abstract
With the deepening and continuous evolution of the world economic globalization, the
competition between countries in science and technology is increasingly fierce. As the
birthplace of intellectual property, universities have gathered a large number of outstanding
talents and scientific research resource, which can drive the development and progress of
surrounding property rights. Especially, since the 18th National Congress of the Communist
Party of China (CPC), our country has been sensitively aware of the lack of key basic
technologies with original innovation and traditional Chinese medicine bottleneck
innovation technology. Therefore, it is particularly important to strengthen the technological
barriers of original creation and bottleneck technology, and form a large number of high-
tech achievements with completely independent intellectual property rights. Chinese
medicine is our outstanding cultural heritage and the most representative of independent
intellectual property rights. The creation of traditional Chinese medicine intellectual
property rights is also an innovation of China's cultural heritage. In this context, it is of
practical significance to analyze and study the creation of traditional Chinese medicine
intellectual property rights.
This project focus on Chinese medicine intellectual property creation and adopts the
combination of literature research and empirical research, There are several specific points
as follows.
Firstly, it summarizes the existing research on intellectual property rights of traditional
Chinese medicine at home and abroad, and summarizes the research status of intellectual
property rights creation in domestic and foreign literature in recent five years, and further
analyzes the research status and sorts out its basic problems. In addition, the current research
methods and directions of scholars were analyzed, and the methods and content adopted in
this paper were also summarized.
Secondly, based on the current situation of TCM creation in X university, the TCM
patent database of X University was built by classifying IPC patents through dawei search
engine, and the development of TCM intellectual property rights such as patent application
and authorization was compared horizontally and vertically respectively.The evaluation
indexes of intellectual property input and output are established by referring to The
Compilation of Statistical Data on Science and Technology of Colleges and Universities.
