I 摘要 网约车市场是一个新兴市场。近年来,网约车市场的蓬勃发展极大地便利了 人们的日常出行,为我国国民经济增长注入了新的活力。但网约车市场发展中也 存在诸如网约车平台之间无序恶性竞争、网约车司机与网约车平台扰乱市场秩序 甚至发生侵权责任事件、安全事故频发等问题,这就急需加强对网约车市场的管 理和服务。 本文以网约车市场中网约车平台、网约车司机和乘客的治理机制为研究对象, 首先,系统性的梳理了国内外有关三方关系相关研究文献及材料,并对网约车相 关概念和共享经济、公司治理、共同治理、网络治理等理论进行简要介绍。随后, 基于文献资料法、问卷调查法、实证分析法,以滴滴网约车市场为例,分析归纳 了网约车平台、网约车司机和乘客三方关系失衡的深层次原因:法律不健全、监 管标准不科学、去劳动关系化影响等。最后,基于现状,提出了多方协力互动共 治机制的概念和特征,网约车市场中网约车平台、网约车司机和乘客有序发展的 策略,如制定“公约”,明晰各方权利和义务关系;市场与政府结合,调节各方 利益关系;形成统一舆论场域,营造共建共治共享外部环境;利用现代化技术手 段,不断创新共治机制等相应策略建议,为提升网约车市场发展的合规性、稳定 性和可预见性提供参考。 关键词:共同治理;共享经济;网约车市场;滴滴出行 Abstract II Abstract OnlinecarHailingmarketisanemergingmarket.Inrecentyears,thevigorous developmentoftheonlinecarHailingmarkethasgreatlyfacilitatedpeople'sdailytravel andinjectednewvitalityintothegrowthofChina'snationaleconomy.However,there arealsosomeproblemsinthedevelopmentofonlinecarHailingmarket,suchas disorderedandviciouscompetitionbetweenonlinecarHailingplatforms,disruptionof marketorderbetweenonlinecarHailingdriversandonlinecarHailingplatforms,even occurrenceoftortliabilityevents,frequentsafetyaccidentsandsoon.Therefore,itis urgenttostrengthenthemanagementandserviceofonlinecarHailingmarket.
