在20世纪70年代末,我国律师制度正式恢复,随着我国法治建设的日益完 备,律师行业也得以快速发展。我国律师队伍逐渐壮大,律师市场也随之产生变 化,律师及律师事务所之间的竞争越来越激烈。律师事务所中律师个人的专业水 平,已经不能在市场竞争中获取充分的优势,而企业所采取的发展战略模式具有 可取之处。目前,我国企业发展战略的研究较为成熟,但缺乏对律师事务所进行 发展战略层面的内容研究。在当前律师事务所市场竞争逐渐激烈的环境下,广东 C律师事务所有着相当程度的发展优势,但诸多问题却也让它逐渐显露劣势。鉴 于此,本文以广东C律师事务所所出现的问题为背景,以企业发展战略模式解 决律师事务所发展问题有力手段为立场,旨在通过对广东C律师事务所的深入 了解;以律师及律师事务所、战略管理理论和战略分析方法等基础理论及文献资 料为分析基础;以广东C律师事务所发展现状为前提,通过解读其概述和发展 历程;运用发展环境分析,总结出困扰广东C律师事务所发展的内外因;以期 通过运用企业发展的战略模式,为广东C律师事务所所存在的问题制定发展战 略并提供有力的实施保障,从而解决其在发展中所遇到的问题。 本文对广东C律师事务所发展战略进行研究探讨,笔者在研究过程中主要 涉及到以下七方面内容:第一部分是绪论,主要是对律师事务所发展战略的研究 背景和研究意义进行论述,同时也介绍了本文研究的主要内容以及将会使用到的 研究方法;第二部分为理论基础与文献综述,首先介绍了律师以及律师事务所相 关的基础概念以及两者之间的关系,其次对战略管理理论进行了简单的阐述,然 后选择了本文将会使用的战略分析方法,最后对本文研究相关的研究文献进行了 整理;第三部分为现状分析,主要是广东C律师事务所的基本情况以及发展历 程的介绍分析;第四部分为环境分析,利用PEST分析法对广东C律师事务所发 展的宏观环境进行分析,利用波特五力模型对律师行业环境进行分析,利用VRIO 模型对广东C律师事务所的内部环境进行分析;第五部分为战略制定,确定广 东C律师事务所的发展目标,选择具体的发展战略,并提出相应的战略实施建 议;第六部分为实施保障,这需要广东C律师事务所加强内部管理制度、完善 内部组织结构、建设独特企业文化、加强业务创新;第七部分为研究结论和未来 展望,在对全文内容进行总结后,了解自身研究存在的不足,并对未来的研究方 向做出展望。 希望本文的研究可以为广东C律师事务所的发展起到一定的促进作用,同 时也为其他律师事务所的发展战略制定提供一定借鉴参考。 关键词:律师事务所;发展战略;战略分析;战略管理 II Abstract Inthelate1970s,China'slawyersystemwasformallyrestored.Withthe increasinglycompleteconstructionoftheruleoflawinChina,thelawyerindustry alsodevelopedrapidly.Withthedevelopmentofourcountry'slawyers,themarketof lawyershaschanged.Thecompetitionbetweenlawyersandlawfirmsismoreand morefierce.Theprofessionallevelofindividuallawyersinlawfirmshasnotbeen abletogainfulladvantagesinthemarketcompetition,andthedevelopmentstrategy adoptedbyenterpriseshasitsadvantages.Atpresent,theresearchonthedevelopment strategyofChina'senterprisesisrelativelymature,butthereisalackofcontent researchonthedevelopmentstrategyoflawfirms.Inthecurrentfiercemarket competitionenvironment,GuangdongClawfirmhasaconsiderabledegreeof developmentadvantages,butmanyproblemsalsomakeitgraduallyexposed disadvantages.Inviewofthis,thispapertakestheproblemsofGuangdongClaw firmasthebackground,takestheenterprisedevelopmentstrategymodeasthe powerfulmeanstosolvetheproblemsofthedevelopmentoflawfirmastheposition, aimingatthroughthein-depthunderstandingofGuangdongClawfirm,basedonthe analysisofthebasictheoriesandliteraturesuchaslawandlawfirm,strategic managementtheoryandstrategicanalysismethod,andbasedonGuangdongClaw firmOnthepremiseofthecurrentsituationofthedevelopmentofthelawfirm, throughtheinterpretationofitsgeneralizationanddevelopmentprocess,throughthe analysisofthedevelopmentenvironment,summeduptheinternalandexternalcauses thatpuzzledthedevelopmentofGuangdongClawfirm,withaviewtomaking developmentstrategiesandprovidingstrongimplementationguaranteeforthe problemsexistinginGuangdongClawfirmthroughtheuseofthestrategicmodelof enterprisedevelopment,soastosolvetheproblemsencounteredinitsdevelopment. Inthispaper,thedevelopmentstrategyofGuangdongClawfirmisstudiedand discussed.Theauthormainlyinvolvesthefollowingsevenaspectsintheresearch process:thefirstpartistheintroduction,whichmainlydiscussestheresearch backgroundandsignificanceofthedevelopmentstrategyofGuangdongClawfirm, andalsointroducesthemaincontentofthisstudyandtheresearchmethodstobeused; thesecondpartisthetheoreticalbasisFirstly,itintroducestherelatedtechnical conceptsoflawyersandlawfirmsaswellastherelationshipbetweenthem.Secondly, itbrieflyexpoundsthestrategicmanagementtheory,andthenselectsthestrategic analysismethodsthatwillbeusedinthispaper.Finally,itsortsouttherelevant III researchliteratureofthispaper.Thethirdpartisthestatusquoanalysis,mainlythe basicsituationofGuangdonglawfirmsandThefourthpartistheanalysisof environment.ItusesPESTanalysistoanalyzethemacroenvironmentofGuangdong Clawfirm,Porter'sfiveforcesmodeltoanalyzetheenvironmentoflawindustry,and VRIOmodeltoanalyzetheinternalenvironmentofGuangdongClawfirm.Thefifth partisthestrategicformulationtodeterminethedevelopmentgoalofGuangdongC lawfirmThesixthpartistheguaranteeofimplementation,whichrequires GuangdongClawfirmtostrengthentheinternalmanagementsystem,improvethe internalorganizationalstructure,buildauniquecorporateculture,andstrengthen businessinnovation.Theseventhpartistheresearchconclusionandfutureprospects. Aftersummarizingthecontentofthefulltext,wecanunderstandtheexistenceof seniorresearchFinally,thefutureresearchdirectionisprospected. Itishopedthattheresearchofthispapercanplayacertainroleinpromotingthe developmentofGuangdongClawfirm,andalsoprovidesomereferenceforthe developmentstrategyofotherlawfirms.
