摘 要
危机后,加强国际金融监管体系改革成为各国政府改革的重中之
重,尤其是危机重灾国努力在财富管理业务创新和金融稳定之中寻找
新的平衡点。本文旨在研究欧美发达国家在财富管理业务中关于消费
者保护的改革思路和理念,为我国财富管理中的消费者保护工作提供
有益参考。本文梳理美国、英国、欧盟、香港等四个国家和地区财富
管理业务的发展历程、现状和监管改革的经验和做法,梳理包括机构
设置、业务范畴、产品设计、信息披露、销售行为等方面的通行做法,
提出加强信息披露;完善消费者保护机制;促进财富管理产品市场有
序竞争;明确目标市场和目标客户群;进行压力测试;注意防范营销
风险;强化产品售后服务;加强功能性监管等八个方面的启示。

ABSTRACT
After the crisis, strengthening the international financial regulatory
system reformation has become a priority of governments reformation,
especially the countries which were severely affected in the crisis endeavor to
fine a new balance between the wealth management business innovation and
financial market stability. This paper aims to study the reform ideas and
concepts on consumer protection in wealth management business in
European countries, providing a useful reference for our consumer protection
related works. This paper outlines the development process, current situation
and the experiences and practices of the regulatory reforms in the USA, UK,
the European Union and Hong Kong wealth management. It also outlines
institutional setting, aspects of the business areas, product design,
information disclosure, sales practices, etc. Suggestions have been made the
following eight areas:Enhance information disclosure;Improve consumer
protection mechanisms;Promote orderly market competition;Define clear
target market and target customer base;Conduct stress tests;Prevent and
mitigate marketing risk;Strengthen post-sales services;Strengthen functional
supervision.
