随着社会主义市场经济的发展，我国国有土地使用权流转制度不断取得进步，但是农 村集体建设用地使用权流转制度却一直固步不前。对于农村集体建设用地使用权流转，我 国目前法律多予以限制的规定。要想打破城乡建设用地二元结构的分割局面，农村集体建 设用地使用权就必须要直接入市，因此允许农村集体建设用地使用权流转已经是必然趋势。 在坚持土地所有权公有制和农村集体土地所有权不变的前提下，通过农村集体建设用地使 用权流转来实现城乡一体化的建设用地市场，做到“同地、同权、同价”，从而保障农民利 益，让农民也享受到城市化和社会经济发展所带来的成果。通过我国部分试点地区的成功 经验表明，农村集体建设用地使用权流转既是必要也是可行的，构建合理的农村集体建设 用地使用权流转制度具有极其深远的现实意义。本文通过查阅大量文献资料和实地的调查 报告，对农村集体建设用地使用权流转的必要性与可行性进行了较深入的研究，全文共分 为四个部分，第一部分，农村集体建设用地使用权流转的概述，具体包括相关的概念界定 以及流转现状的介绍；第二部分，农村集体建设用地使用权流转的必要性分析，具体包括 目前国内学者的主流观点以及流转的利弊分析；第三部分，农村集体建设用地使用权流转 的可行性分析，具体包括可行性的理论基础和实证分析；第四部分，农村集体建设用地使 用权流转的立法构想及制度构建。 关键词，农村集体建设用地使用权流转 必要性 可行性II Abstract With the development of socialist market economy,we made great progress in the transfer system of state-owned land,while the transfer system of collective construction land of farmers is still the same.The use right transfer of collective construction land of farmers is most be restricted in the law in our country. The collective land use right must be put on the market in order for the dual ownership structure to be broken.On the premise of public ownership to land property and without changing the collective ownership to rural land,we can build a unified land market for thecirculation of rural land use rights so that the same land,with the same right can be on the market at the same price and peasants can enjoy the benefits of urbanization and economic development.We get much sucessful experience in the experimental units,which shows the necessity and feasibility of the use right transfer of collective construction land of farmers.It has a far-reaching meaning in designing a reasonable use right transfer system of collective construction land of farmers.In the base of larger numbers of literature and field survey,I make deep research in this article on the necessity and feasibility of the use right transfer of collective construction land of farmers.There are four parts in this arctile.The first part is summarized the use right transfer system of collective construction land of farmers,including explaining the relevant concepts and transfer status.The second part is analyzed the necessity of the use right transfer of collective construction land of farmers, including mainstream views of domestic scholars currently and analysis of the pros and cons of the transfer.The third part is analyzed the feasibility of the use right transfer of collective construction land of farmers, including the theoretical basis and empirical analysis about the feasibility.The four part is designed the use right transfer system of collective construction land of farmers,including legislation and system construction.
