——以某钢结构工程施工合同为例

摘要

随着国家的逐步富强,国民经济的快速发展,现代化、城镇化的建设脚步加

快,工程建设项目的不断扩大,复杂度和技术难度也不断的增加,因而使得在建

设的具体实施过程中施工企业所面临的不确定因素也不断的增加,由此产生的风

险加大。如何能够有效的控制施工中存在的风险,保证承包方和发包方双方的利

益,需要双方通过签订施工合同来规范,施工合同是关系着每个企业生存和发展

的保障。

我国的建筑市场所呈现出来的局面是施工队伍庞大,供不应求,整体利润率

相对较低,产高利底,宄其原因,对建筑工程施工承包合同的管理以及对风险的

预防和控制不到位是其中一项重要因素,在激烈的市场竞争中,一个施工企业要

想从中获取利润,确保公司的稳定以及长远发展,就必须加强公司的风险管理能

力。

本文通过将施工合同风险管理相关理论方法与实际工程案例相结合,从施工

企业角度出发,分析了施工合同中存在的风险因素,通过对风险因素进行评价制

定出了相应的规避和控制对策以及保障措施,确保施工企业合同风险管理工作顺

利开展,希望以此能够帮助施工企业解决施工企业合同风险管理工作中所遇到的

问题,对施工企业以后施工合同的风险管理工作具有一定的借鉴意义。

At present, China's construction market tend to come out of the situation is a

huge construction team,in short supply, relatively low overall profitability,

one of the important factors in the fierce market competition, an enterprise wants to

profit from the construction to ensure the company^ stability and long-term

development, we must strengthen the company's risk management capabilities.

practical engineering cases combined from the perspective of construction enterprises,

analyzes the risk factors that exist in the construction contract, through the evaluation

of the risk factors to develop an appropriate control measures and to avoid and

safeguards to ensure that the risk management of construction enterprise contract

work smoothly, hoping to be able to help enterprises solve the problem of
