摘 要
国家为了解决中小企业融资难的问题，在 2010 年 3 月七部委联合
下发了《融资性担保公司管理暂行办法》，将融资性担保企业从担保
行业中分离出来，加以规范，规范的最后期限为 2011 年 3 月 31 日

2012 年广东省发生了涉案金额达 9 个多亿的“华鼎创富”案，融资性
担保企业仍未得到市场普遍认可。本文以深圳市融资性担保企业为研
究对象，通过实地调研、研究相关资料和文献等方法，对深圳市融资
性担保企业的发展情况及存在的主要问题进行分析，从法律法规的规
定、融资性担保业务特点的要求和融资性担保企业组织结构的要求三
个方面，对融资性担保企业应当建立健全的风险控制制度进行研究，
以期从研究中总结出可行的风险控制模式，指导企业实践，实现七部
委发文的初衷之一，即“提高社会特别是银行业金融机构等债权人对
融资性担保行业的认可度，有利于更好的支持和促进广大中小企业发
展。”并且在此基础之上，初步探索融资性担保企业运行良好所需的
内外部环境，尤其是常规监管基本框架问题，并提出政策建议，抛砖
引玉，希望企业界和理论界能做进一步、有益地探讨

THE RISKING SYSTEM RESEARCH ON
FINANCING GUARANTEE ENTERPRISES IN
SHENZHEN
ABSTRACT
In order to solve the financing dilemma of small and medium-sized
enterprises, in March 2010, seven ministries jointly issued the Interim
Regulation on the Administration of Financing Guarantee Companies.
From then on financing guarantee companies have been supervised by the
government and all the companies should comply with the regulation no
later than March 31, 2011. But in 2012 the “hua ding and chuang fu” case
happened in Guangdong Province and the amount of money involved
amounted to more than 900 million RMB. There still are many problems
about financing guarantee enterprises. Financing guarantee companies have
not been generally recognized by the market so far.
This paper takes Shenzhen financing guarantee enterprises as the
research objects to study these problems by investigation and other
research methods. The paper analyses the development of financing
guarantee enterprises in Shenzhen and what main problems are about these
enterprises. Respectively from three angles, i.e. the requirements of laws
and regulations 、business characteristics and organizational structure of
the enterprises, this study discusses which risking control system the
financing guarantee companies should establish ，and then summarizes
