随着律师行业的飞速发展和行业竞争的日趋激烈,律师事务所规模化正成为律师 事务所发展的重要趋势。与国际律师事务所相比,我国律师事务所存在起步晚、管理 落后、专业化程度低、竞争力弱、无战略规划等问题。为顺应经济全球化,法律服务 的专业性和多样性的需求,我国律师事务所也应当与国际接轨,向规模化、专业化方 向发展,以适应市场需求。近年来,在中国特色社会主义法治体系建设的过程中,司 法部、律师协会也出台了一系列政策措施,以期引导我国律师事务所做大做强、规模 化发展。一些具有前瞻性的律师事务所也将律师事务所规模化纳入律师事务所战略规 划,走向规模化发展之路。因此,我国律师事务所如何根据自身条件进行规模化发展 的战略规划,如何向“博而专”的规模化方向发展,如何应对规模化发展中的问题便 成为律师行业重点关注的问题。 本文以DC律师事务所为研究对象,在调查研究的基础上,综合运用案例分析等 方法来分析DC律师事务所规模化发展,以期为我国律师事务所规模化发展提供借鉴。 文章开篇便对研究背景、相关理论与文献综述等进行了论述,后对我国律师事务 所规模化发展进行了分析。因我国对律师事务所规模化界定存在模糊不清的问题,笔 者认为应当从业务收入规模、从业人员数量、业务领域范围三个方面来衡量律师事务 所规模。而律师事务所规模化发展的动因是外部需求及内在动力的结果。律师事务所 规模化发展的方式包括:内部扩张、合并、组建律师事务所联盟以及事务所联营。然 后笔者对我国律师事务所规模化的典型代表DC律师事务所规模化发展进行了分析。 DC律师事务所实现如今的规模,成为国际化大所,笔者认为是其先后经历了四个时 期发展的结果,其通过内部扩张、合并、联盟的方式实现了规模化,但过程中也有亟 待解决的问题。最后,针对DC律师事务所规模化发展所面临的问题,笔者认为应当 采取以下措施:其一,启动总分所一体化建设;其二,建立风险防控体系;其三,加 强文化建设;其四,提高品牌效应;其五、推进国际化进程。 关键词:规模化;法律服务;战略管理 II Abstract With the rapid development of the lawyer industry and the increasingly fierce competition in the industry, the scale of law firms is becoming an important trend in the development of law firms. Compared with international law firms, my country's law firms have problems of late start, backward management, low degree of specialization, weak competitiveness, and lack of strategic planning. In order to meet the demands of economic globalization, professionalism and diversity of legal services, my country's law firms should also be in line with international standards and develop in the direction of scale and specialization to meet market demands. In recent years, in the process of building a socialist rule of law system with Chinese characteristics, the Ministry of Justice and the Law Society have also issued a series of policy measures with a view to guiding my country’s law firms to grow bigger and stronger and develop at scale. Some forward-looking law firms have also incorporated the scale of law firms into the strategic planning of law firms, and are moving towards the path of scale development. Therefore, how to carry out the strategic planning of large-scale development according to its own conditions, how to develop in the direction of "Bo and specialized" scale, and how to deal with the problems of large-scale development have become the focus of the lawyer industry. In this thesis, DC Law Firm for the study, on the basis of investigation and research, comprehensive use of case studies and other methods to analyze DC Law Firm scale development, to provide a reference for the development of large-scale firm lawyers. At the beginning of the article, it discusses the research background, related theories, and literature reviews, and then analyzes the scale development of my country's law firms. Because of the ambiguous definition of the scale of law firms in my country, the author believes that the scale of law firms should be measured in terms of the scale of business income, the number of employees, and the scope of business areas. The motivation for the large-scale development of law firms is the result of external demand and internal motivation. The methods of large-scale development of law firms include internal expansion, mergers, the formation of law firm alliances, and firm joint ventures. Then the author analyzes the large-scale development of DC law firm, a typical representative of the large-scale law firm in my country. DC Law Firm achieved its current scale and became a major international institution. The author believes that it has experienced four stages of development. It has III achieved scale through internal expansion, mergers, and alliances, but there are also urgent solutions in the process. The problem. Finally, in response to the problems faced by the large- scale development of DC law firms, the author believes that the following measures should be taken: First, start the integrated construction of the head office; Second, establish a risk prevention and control system; Third, strengthen cultural construction; Fourth, improve the brand effect; fifth, promote the process of internationalization.
