我国招投标制度的推广,发展于我国社会主义计划经济向市场经济的过渡时期,具
有中国特色社会主义的特点,是政府实施宏观调控的重要手段,目前我国建筑市场体系
日益成熟,从招标产生到最后签署工程施工合同基本上已经有了比较成熟的规章制度和
法律法规,但是由于我国招投标体制出现较晚,整个招投标过程中人为因素较多,涉及
的范围较广,在整个招投标活动中出现了不少问题,自身也存在着不少缺陷。这就导致
了在招投标在各个方面行为的不规范。某招标公司针对我国建筑工程招投标市场目前存
在的问题,提出了应该健全各项规章管理制度、建立完善的有型交易市场、加强招投标
单位的自身素质,从政府宏观调控到自身教育。最后通过案例分析系统的阐述了从政府
部门、招标单位、招标代理机构、施工单位的行为应该如何规范化,以及未来招投标市
场的发展情况。

Abstract
As market economy develops with each passing day, tendering and bidding has become
an essential product of development of market economy. In 1979, tendering and bidding was
implemented in the field of architecture and in 1984, The Interim Provision of Tendering and
Bidding for Construction Projects was issued by jointly by the State Planning Commission
and competent authorities. By the end of 1984, the Ministry of Foreign Economic Relation
and Trade has established some special bodies such as China Mechanical and Electrical
Equipment Tendering Center. In 1985, special tendering bodies began to arise throughout the
country. Hence, tendering and bidding was launched in China.
Popularization of the tendering-bidding system in China developed in the period of
transition from socialist planned economy to market economy. It is featured by socialism with
Chinese characteristics and is an important means for the government to implement
macroeconomic control. Nowadays, the building market system is becoming increasingly
mature in China. Well proven rules, laws and regulations are basically available for various
stages from generation of tendering to final signature of a construction contract. However, the
tendering-bidding system appears relatively late in China with many human factors in the
whole course of tendering and bidding and a wide range involved. As a result, not a few
problems occur in tendering and bidding activities with a lot of defects in them. This has led
to nonstandard behaviors in various aspects in tendering and bidding. In terms of the existing
problems in the current construction project tendering and bidding market in China, it is
proposed that managerial rules and regulations should be strengthened, a perfect tangible
trading market should be established and the constitution of tendering and bidding bodies
themselves should be enhanced, with transition from government’s macroregulation to self
education. Finally, it is stated, through the case analysis system, as how should the acts of
government departments, tendering bodies, tendering agents and construction units be
normalized and as what will be the development situation of tendering and bidding market in
the future.
