在现时的条件下，我国正着力构建社会主义和谐社会。改革开放以来，随着我国经 济社会的飞速发展，社会的其他领域也在不断进步。为了保障经济社会的健康稳定的发 展，在我国建立和谐的社会主义就显得尤为紧迫。和谐社会的构建，需要法律作为保障， 而在法律中，与创建和谐社会最为贴切的，非法律宽容莫属。但是，在我国，对于法律 宽容的运用实施却显得尤为匮乏。笔者以法哲学为基础，以法理学为视角来探讨法律宽 容在我国实施的可能性。 目前，国内对于法律宽容的研究还较多地停留在法学以外的其他领域，在法学领域， 尤其是在法理学的领域内，对法律宽容进行探讨的学术报告与著作更是凤毛麟角，其中 陈根发博士的《宽容的法理》一书比较有代表性。从政治、文化、法律、宗教等多个层 面对法律宽容进行了综合的研究。对于法律宽容在立法上广泛的应用问题，学者们的意 见并不统一，有的学者认为法律宽容应当应用于法律之中，作为法律的一种高贵的品质， 才更能体现出法律的人文关怀，更显得法律具有人情味；还有的学者认为，法律中不应 当存在宽容精神，因为宽容的法律不能对人们起到威慑的作用，不足以起到警示犯罪分 子的作用，影响法律的权威性。 本文主要采用了价值分析法、法律解释学研究方法、社会学研究方法和实证分析研 究方法，从应然的角度对法律宽容在我国实施的逻辑可行性进行探讨性的分析。本文共 分为六个部分，依次是导言、法律宽容的概述、法律宽容的价值取向、法律宽容在法律 运行体系中的表现形式、法律宽容实施的难点以及解决办法和结语。导言引入研究本题 的背景和笔者的一些写作动机；法律宽容的概述一章描述了法律宽容的内涵以及它的形 成与发展；第二章法律宽容的价值取向主要阐述了法律宽容与自由、秩序和正义的内在 联系；接下来的法律宽容在法律运行体系中的表现形式一章中，研究法律宽容在立法、 执法和守法三个阶段的表现形式；第四章法律宽容的难点以及解决办法，列举了法律宽 容实施所面临的困境以及提出自己的解决办法和意见；最后在结语的部分阐明自己对于 法律宽容在我国实施的可行性的观点。 关键词，宽容；法律宽容；法律宽容实施II Abstract Under the present conditions, our country is focused on building a harmonious socialist society. The author based on the philosophy of law, jurisprudence perspective to explore the possibility of the implementation of the law of tolerance in our country.
