摘要
我国面临的出口压力不断增大,外资也面临着不断流失的危机,与此同时消
费增长还比较乏力。这给我国经济可持续增长造成巨大压力,在这种背景下,经
济的转型升级势在必行。本文以知识产权保护对创新的激励为出发点,分析知识
产权保护对出口升级及外向对外直接投资的影响机制。本文的主要工作如下:
(1)本文为知识产权保护对于出口质量的影响机制提供了理论框架。研发和
外国直接投资与出口质量呈现正相关关系,而知识产权保护的加强会鼓励 R&D
支出的增长并且吸引更多的 FDI。通过实证检验发现:在发展中国家只有 FDI
在 IPR 对出口质量的提升中起到中介作用,而在发达国家 R&D 和 FDI 两个因素
都起到中介作用。另外,知识产权保护对出口质量的影响在高技术产业要更显著,
而对于分化精细的出口产品质量影响尤为明显

(2)关于知识产权保护对出口成熟度的影响。首先,知识产权保护会导致一
个国家吸引更多 FDI、研发活动更为活跃并增加进口。外国直接投资不仅为东道
国带来了资金,同时也带来了技术和管理经验;进口是技术扩散的重要方式;研
发活动会很好地改善一国的创新能力,三种方式都会促进技术的积累。技术的发
展会提升一国出口成熟度。实证结果显示:在发展中国家,进口和 FDI 在知识
产权保护与出口成熟度的关系中起到中介作用;而在发达国家起中介作用的则是
研发和 FDI。如果将发展中国家起中介作用的进口和 FDI 按其来源进行划分,则
会发现在发展中国家起中介作用的实际上是发展中国家间的进口以及发达国家
间的投资

(3)在已有关于对外直接投资经典理论基础上全面分析了知识产权保护对外
向对外直接投资的影响机制。基于 IDP 理论,考虑到知识产权保护对所有权优
势的影响和其他宏观经济变量对对外直接投资的影响,加入了三个新的变量。实
证结果表明:知识产权保护随着经济发展水平的不同会表现出不同的作用机制

在发展中国家 IFDI 在 IPR 与 OFDI 的关系中起到中介作用;而在发达国家中介
作用则依赖于 R&D。另外,对发展中国家 FDI 来源进行细分发现发展中国家之
间的 FDI 的中介作用为正,而发达国家对发展中国家的投资的中介作用为负

(4)移民作为知识转移的重要方式对一国竞争力会产生负面影响。而知识
产权保护作为调节变量,对移民的回流具有正向影响。这一调节作用随着经济的
发展不断减弱,即在发展中国家所起作用要高于在发达国家。另外,如果聚焦于
女性移民则知识产权保护对移民与出口竞争力的调节作用会随着经济的发展表
现出 U 型关系。6

Our country faces a serious economic condition that the export pressure is
increasing, the foreign direct investment is outflowing and the consumption growth is
weak. This poses great pressure to China&39;s economic growth. In this context, the
economic transformation and upgrading is imperative. Based on the point that the
incentive of IPR protection to innovation, we make an analysis of the influence
mechanism of IPR protection on export upgrading and outward foreign direct
investment. This paper do the work as following:
(1) This paper provides a testable framework to explain the impact of IPR
protection on export quality. Research and development (R&D) spending and foreign
direct investment (FDI) are positively correlated with a country’s export quality.
Furthermore, intellectual property protection can induce more FDI and R&D spending.
Therefore, we expect that there may be an indirect relationship between intellectual
property protection and export quality. The empirical results suggest that the influence
paths of IPR protection on export quality are different between developed and
developing countries. FDI plays a mediating role in the relationship between IPR
protection and export quality in developing countries, while this mediating effect in
developed countries is dependent on R&D and FDI. In addition, this impact is
statistically significant in high technology industries. Especially, IPR protection plays
an extraordinary important role in enhancing the export quality of differentiated
high-technology products.
(2) IPR protection can lead to more FDI, R&D spending and imports. FDI not
only provides capital for the host countriy, but also brings about technology and
management experience. Import is another way of technology diffusion. R&D
activities can effectively improve a nation’s innovation ability and technology
accumulation. Technology will help a country develop its products as well as its
export sophistication. Throughout our paper, we will examine the mediating role of
R&D and technology transfers. The empirical results show that in developing
countries, foreign direct investment (FDI) and import play a mediating role in the
relationship between IPR protection and export sophistication; while for developed
countries, the corresponding mediating effects rely on research and development
(R&D) and FDI. In addition, when making a more accurate classification of8
developing countries’ imports and inward FDI origin, we find that the mediating
effect depends on South-South imports and North-South FDI.
(3) This paper comprehensively studies how IPR protection affects OFDI. We
augment the Investment Development Path (IDP) with explanations derived from
domestic IPR protection and some macroeconomic factors. The empirical results
suggest that there are different influence mechanisms in developed and developing
countries. In developing countries, FDI plays a mediating role in the relationship
between IPR protection and OFDI. While the mediating effect in developed countries
relies on R&D. In addition, when making a finer disaggregation on developing
countries’ inward foreign direct investment (FDI) origin, we find that the impact of
IPR on OFDI relying on South-South FDI is positive but negative depending on
North-South FDI.
(4) This paper comprehensively studies how IPR protection affects
competitiveness. IPR protection has positive moderating effect on the relationship
between migrants and competitiveness. And this impact decreases with the extent to
which the technology of the home country approaches the technology frontier. When
focusing on the female migrants, we find that this impact exists and shows a
U-relationship over the course of economic development.
