摘要
我国的土地评估行业起步于 1992 年，发展至今不过短短的二十几年，但在这二十几年里却经历
了行业的三次改革，每一次改革后，土地评估机构面临的风险都不尽相同。随着近两年来，土地评
估机构和评估人员涉及诉讼的案件逐渐增多，部分土地估价师不得不接受民事赔偿、行政处罚甚至
刑事处罚，大家开始意识到土地评估行业的风险不但不低于其他评估行业，而且与其他评估行业相
比还有其自身的特殊性。另外，2016 年《中华人民共和国资产评估法》实施后，评估机构在新的法
律环境下又将面临不一样的风险

本文首先对研究背景、研究意义和研究目的进行了阐述；从对所研究内容的概念、理论入手，
在综合借鉴国内外已有研究、查阅案例、问卷调查的基础上，分析了现阶段辽宁省土地评估机构的
现状，将土地评估风险分为系统风险和个别风险两类，其中个别风险又分为经营风险、管理风险和
技术风险。通过对辽宁省土地估价师协会的走访调查，对各机构调查问卷的统计分析，结合相关理
论，对土地评估中可能存在的各类风险进行辨识和评估，分别提出了管理措施，并针对土地评估的
特点，提出采用分解工作程序来控制管理风险的方案。经过对土地评估机构工作流程及土地评估业
务的深入研究，设计了针对土地评估的“七步工作法”，明确了每一步的工作内容和工作程序后，分
析每一步工作中可能遇到的风险，针对风险特征，提出解决方案和建议，最终实现控制风险的目的

土地评估涉及时间较长、工作步骤多、涉及的知识面广，不同地区评估机构的风险也会有所不
同，由于篇幅所限，本文仅从辽宁省土地评估机构目前普遍存在的风险进行了进行考虑，难免对一
些特殊情况有所遗漏。后续可以进一步加强这方面的研究

Abstract
Land evaluation industry in China began to in 1992. Yet three reformations occurred in
the comparatively short history, each followed by significantly diverged risks. In recent years
some land valuers have endured civil compensations, administrative penalties or even
criminal punishments as a consequence of increasing lawsuits referring to agencies and
individuals. In the light of this, not only the equivalent risks but also the specialties in land
evaluation industry have been revealed. Moreover, the enforcement of Law of People’s
Republic of China on Asset Evaluation in 2016 has confronted agencies with new diverse
risks.
This paper initially expounds the background information, significance and purpose of
the research. It starts with the definitions and principles, proceeds based on case studies,
results of existing researches along with surveys, and reach the analysis of current situation in
agencies in Liaoning Province. In this paper, risk of land evaluation is categorized into
systematic risk and individual risk (including operational risk, administrative risk and
technical risk). Furthermore, this paper distinguishes and assesses the potential risks, which
lead to a sequential risk control plan. During the entire process statistics from surveys and
questionnaires are closely integrated with theoretical studies. Finally, the approach of “seven
steps” in land evaluation is designed and illustrated at the final stage of research. According to
the observation in previous stages, a comprehensive work scheme incorporating clarification,
analysis, and project is generated to fulfill the task of risk control.
Land evaluation involves many steps, long time, involving a wide range of knowledge,
and risk assessment agencies in different regions will be different. Because of the limited
space, this paper only from the risk of Liaoning province land assessment agencies present are
considered, there are missing in some special cases. Follow up can further strengthen the
research in this area.
